Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and the operator of The Oathless. By creating an account, accessing, or playing The Oathless (the "Game"), you agree to these Terms. If you do not agree, do not use the Game.
The Game is in Alpha. The Oathless is an early, in-development build provided for testing and feedback. Features, balance, content, and player data may change, be reset, or be removed at any time. See section 9 ("Alpha Status & Data Resets") before you play.
1. Who we are
The Game is operated by Lawrence Murrell, a sole trader based in the United Kingdom, trading as "The Oathless" ("we", "us", "our"). You can contact us at Quoeiza@theoathless.com.
The Game is available at theoathless.com and may also be playable as an embedded experience on third-party platforms such as Discord and itch.io. When you play through a third-party platform, that platform's own terms and policies also apply to you.
2. Eligibility
- You must be at least 13 years old to use the Game. If the age of digital consent where you live is higher than 13, you must meet that age, or have the consent of a parent or guardian.
- If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.
- You must have the legal capacity to enter into this agreement and must not be barred from using the Game under any applicable law.
The Game contains fantasy combat with stylised pixel-art violence and "blood", and an open text chat in which other players may use strong language. We do not control what other players type. If this is not suitable for you, please do not play.
3. Your account
- You may register using an email address and password, or by linking a Discord account. We do not offer guest accounts.
- You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
- You must provide accurate information and keep it up to date.
- One person should not operate multiple accounts to gain an unfair advantage, evade a ban, or abuse promotions or rewards.
- Tell us promptly at Quoeiza@theoathless.com if you believe your account has been accessed without your permission.
4. Licence to play
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to access and play the Game for your own private, non-commercial entertainment. We retain all rights, title, and interest in and to the Game, including its code, art, audio, characters, names, and other content. These Terms do not transfer any ownership of the Game to you.
5. Acceptable use & code of conduct
When using the Game and its chat features, you agree that you will not:
- Cheat, exploit bugs, use unauthorised third-party software, bots, automation, or modify the client to gain an advantage or disrupt the Game;
- Harass, threaten, bully, defame, or impersonate others, or post hateful, discriminatory, sexually explicit, or otherwise unlawful content in chat, character names, or any other field;
- Disrupt, overload, or attempt to gain unauthorised access to our servers, infrastructure, or other players' accounts;
- Reverse engineer, decompile, or extract source code from the Game, except to the limited extent that applicable law expressly permits despite this restriction;
- Sell, trade, buy, or transfer accounts, virtual items, or in-game currency for real-world money or value outside the Game ("real-money trading");
- Use the Game for any commercial purpose, or to develop a competing product, without our written permission;
- Break any applicable law while using the Game.
6. User content & chat
The Game lets you submit content such as chat messages and character names ("User Content"). You remain responsible for your User Content. By submitting it, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, transmit to other players, and display it as needed to operate and moderate the Game.
We are not obliged to monitor User Content, but we may review, filter, or remove it, and we may suspend or remove accounts that breach section 5. Chat is a live feature: messages you send are visible to other players in your session and may be logged for safety, moderation, and abuse-prevention purposes (see our Privacy Policy).
7. Virtual items & in-game currency
- The Game includes virtual items, equipment, character progression, and in-game currency (such as "copper"). These are licensed to you for use within the Game only.
- Virtual items and currency have no real-world monetary value, cannot be redeemed for cash, and cannot be transferred or sold outside the Game.
- You do not own virtual items; you hold a limited licence to use them within the Game, which ends when your licence or account ends.
- We may add, remove, modify, rebalance, or reset virtual items, currency, and progression at any time, particularly during Alpha (see section 9).
8. Purchases (cosmetic microtransactions)
Paid purchases are not yet available. This section will govern them once they launch, and we will update these Terms and notify you in-game before any purchases go live.
When paid content launches, the Game may offer optional cosmetic items for real money. The following will apply:
- Payments will be handled by a third-party payment provider. We will not store your full card details. Prices will be shown before you confirm a purchase and may include applicable taxes.
- Cosmetic purchases unlock a licence to use the item in-game; they confer no ownership and no real-world value.
- Right to cancel (digital content). Under UK and EU consumer law you normally have 14 days to cancel a purchase of digital content. Because cosmetic items are delivered to your account immediately, when you buy one you will be asked to consent to immediate delivery and to acknowledge that you therefore lose your 14-day right to cancel once delivery has begun. If you do not give that consent, the item cannot be delivered immediately.
- Nothing in this section removes your statutory rights, including the right to a remedy if purchased content is faulty or not as described.
- Initiating a chargeback or payment dispute without first contacting us may result in suspension of your account pending resolution.
9. Alpha status & data resets
The Game is provided on an "as is" and "as available" basis during Alpha. You acknowledge that:
- The Game may contain bugs, may be unstable, and may be unavailable from time to time;
- We may, between testing rounds or at any other time, reset or wipe player progress, including characters, inventories, stashes, currency, and statistics;
- We may change, suspend, or discontinue all or part of the Game, with or without notice.
Where you have paid for content, your statutory consumer rights are unaffected by this section.
10. Suspension & termination
We may suspend, restrict, or terminate your access to the Game (in whole or in part) if you breach these Terms, if we reasonably suspect fraud or abuse, or where we are required to do so by law. You may stop using the Game and request closure of your account at any time by contacting us. On termination, your licence to use the Game and any virtual items ends.
11. Disclaimers & liability
To the fullest extent permitted by law, the Game is provided without warranties of any kind, and we do not guarantee that it will be uninterrupted, secure, or error-free.
Nothing in these Terms limits or excludes our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for your statutory rights as a consumer.
Subject to the paragraph above, we are not liable for loss of in-game progress or virtual items, for losses that were not reasonably foreseeable, or for losses arising from your breach of these Terms or from third-party platforms or services. The Game is provided for personal use; we are not liable for any business losses.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, for example through the Game or this page. The "Last updated" date above shows when the Terms were last revised. Continuing to use the Game after changes take effect means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of England and Wales, and disputes are subject to the courts of England and Wales. If you are a consumer resident in the EU or elsewhere, you keep the benefit of any mandatory consumer-protection rights of the country where you live, and may bring proceedings there where the law allows.
